FREQUENTLY ASKED QUESTIONS

Q: I thought my judgment was an order for the debtor to pay? Isn't the debtor breaking the law by not paying me?

A: It is not against the law to owe money. Most debtors never pay and unless the creditor happens to be legally schooled or familiar with the local court processes (which can be extremely complicated), they are out of luck. That is why we are in this business.

Q: Are you a collection agency?

A: We are not a collection agency. Collection agencies process debts in bulk. They send out thousands of nasty letters and call debtors to try to get them to pay. We actually "take assignment" on your judgment. Then we have the authority to conduct thorough asset investigations, including surveillance, bank locates and more, and even bring your debtor back into court. Our cases are treated individually and expertly. We are not afraid to put out money for enforcement procedures. And we have resources that collection agencies will never have.

Q: Are you an attorney?

A: No, we are Judgment Recovery Specialists. You will need to pay an attorney a retainer fee of $750-$2500 up front and after that money is exhausted, you will be charged $175-$350 an hour for them to continue working on your judgment case. Even then, you may not see a dime if the debtor does not have any assets. Also, while many attorneys are skilled at getting judgments, most are not familiar with effective post-judgment strategies.

Q: But how much will it cost me, really?

A: It costs you absolutely nothing to utilize Three Rivers Judgment Recovery to try and recover the monies you are owed. We advance all costs. If there are additional court expenses, we petition the court to add these to the judgment. We work with attorneys at no cost to you. In short: We spend the time and the money. If we do not collect, it still costs you nothing.

Q: My Attorney is assigned to my case, but they have not been able to pursue the debtor. Can you take over?

A: Sure. We do ask that you call your attorney first and request that they withdraw from the case. They will need to file this through the courts. We cannot do that for you.

Q. Can you guarantee that you will collect on my judgment?

A: There are no guarantees. We will exhaust every effort and strategy to recover the judgment for you. There are those who will find every loophole and cheat to avoid paying. There are only a few circumstances that will result in a dead-end. Even then, we retain the files and information on all of our debtors in the event their circumstances change. Sometimes years will pass before money is collected. We never give up. You WILL get a check if we recover money regardless of how long it will take.

Q. How and when will I receive any money recovered?

A. There are two ways we may recover the judgment money owed. 1) We collect through Wage Garnishments or if the debtor settles out of court and agrees to pay weekly, bi-weekly or monthly installments. In this case you will receive quarterly payments. We would waste time, manpower and paper if we had to pay hundreds of creditors on a monthly basis. 2) We are able to settle with the debtor for the full amount OR we are able to get the full amount through a bank garnishment, property lien sale or other similar circumstances. In this case we split the total amount recovered as agreed.

Q. How long is my judgment good for?

A: In Indiana Judgments are good for 20 years.

Q. What do I need to do after I sign the required documents for TRJR to pursue my judgment?

A: Nothing. Sometimes it takes years to satisfy a judgment. If we can discover assets next month, next year or anytime in the future, you will be the first to be informed.
